Online marketplaces have made it easier than ever to purchase existing trade marks — but convenience often masks significant legal risk.


Under the Trade Marks Act 1995, trademark assignments must be executed correctly and recorded with IP Australia. Many marketplace transactions fail to meet these requirements, potentially leaving the buyer without valid ownership.
